The threshold was written before the observation existed. That is what stops a state from being argued into place after the fact.

Four states, no probabilities

On 15 January 2025 US BIS issued two additional rules tightening advanced-computing semiconductor controls, foundry due diligence and the Entity List, explicitly updating prior controls and restricting diversion to PRC-linked destinations.
